pretrial diversion

The Hendricks County Prosecutor's Office offers an alternative path for individuals facing criminal charges. Through the Pretrial Diversion Program, eligible participants may resolve their case without a conviction being entered on their record, provided they meet specific conditions.

Participation in this program is not guaranteed and is limited to qualifying cases. Those accepted will be required to follow terms outlined in a written agreement. This may involve educational classes, substance use screening, and payment of all required fees and court costs. It is important to keep in mind that we cannot offer legal advice. Questions about eligibility or legal obligations should be directed to your attorney.​​

When Does the Diversion Start?

Your diversion period does not begin at your court appearance. It starts only after all of the following steps are completed: -The Diversion Agreement is signed by all necessary parties -All court fees and program costs are paid in full -Any restitution ordered has been paid in full -A signed copy of the agreement and payment confirmation are submitted to the Court. Until these steps are complete, your diversion has not officially started.

When

will my case be dismissed?

Your case will be dismissed only if you complete all of the terms of your agreement, remain arrest-free throughout the diversion period, and the full term of the agreement has passed without violations. Any material showing completion of conditions should be sent to your attorney or to the prosecutor’s office if you do not have an attorney. A review hearing will be set when you enter into the Pretrial Diversion to evaluate that you have completed your agreement at the end.

how will i know when my case is dismissed?

Visit MyCase.com, 72 hours after the end date of your Pretrial Diversion agreement, to confirm your case has been dismissed.
