infraction deferral

The Hendricks County Prosecutor’s Office offers an Infraction Deferral Program designed for eligible drivers who have been cited for select traffic violations. This program provides an opportunity to avoid a conviction on your driving record by successfully completing the terms of the deferral agreement.

 

To participate, individuals must enter into a formal agreement with the Prosecutor’s Office. Conditions of the program typically include payment of a deferral fee, completion of an online driver safety course through an approved provider, and maintaining a clean driving record for the duration of the deferral period. Final eligibility is determined at the discretion of the Hendricks County Prosecutor’s Office.

Eligible Infractions :

-Speeding

-Ignoring traffic signals or stop signs

-Improper lane usage (e.g., driving left of center)

-Illegal passing

-Tailgating

-Failure to yield

-Failure to use turn signals

Basic Eligibility
Criteria:

To be considered for the deferral program, you must

- Not have admitted guilt or paid the traffic ticket

- Not possess a commercial driver’s license (CDL)

- Have received the citation in Hendricks County, Indiana

- Be at least 16 years of age

how it works:

If your application is approved, you’ll be required to sign a deferral agreement, complete the required online course, and pay all associated fees. Do not pay your ticket through the court, as this may result in a permanent conviction and make you ineligible for the program.

 

All requirements, including class completion and fee payment, must be fulfilled by the specified due date unless an extension is granted. Additional instructions will be provided once you are deemed eligible.

 

Failure to submit the necessary documents or appear for any required court dates may lead to a default judgment against you.

Eligibility is at the discretion and determination of the Hendricks County Prosecutor's Office.

Most participants will qualify for a nine (9) month deferral period. If you are interested in applying, please contact our office before taking any action on your ticket.
